As you already may know of the regulation, U.S. Customs Services has published a final rule in the Federal Register requiring NVOCC's to transmit manifest data electronically to U.S. Customs Service at least 24 hours before loading at the foreign port. The effective data for this new rule is Dec. 2, 2002. The enforcement date for the new regulation will take effect for any vessel beginning voyages on or after Feb. 1st. 2003, from which date Customs service will assess penalties. If the NVOCC defaults and does not file the manifest timely and/or incorrectly, liquidated damage penalty of $5000.00 for the first time offense and $10,000.00 for each occurrences thereof, can result.

As ruled by the Department of Treasury, NVOCC:

  1. Shall have a Standard Carrier Alpha Code(SCAC).
  2. Is licensed or registered by the Federal Maritime Commission.
  3. Is in possession of a minimum $50,000.00 International Carier Bond: however, port directors are authorized to set higher bond amounts based puon their experience with the NVOCC's.
  4. Must be able to transmit, electronically, the cargo manifest to Customs through the Automated Manifest System(AMS) at lease 24 hours before loading at the foreign port. If the NVOCC decides not to utilize the AMS, then the company will be required to provide this conidential information to the vessel carrier, who will then submit the information to the U.S. Customs Service, with possible higher cost.
